1. Agreement to these Terms
By downloading, accessing, or using a Lagodish Tech mobile application, website, or related service that links to these Terms (collectively, the “Services”), you agree to these Terms. If you do not agree, do not use the Services.
If a specific Service presents additional terms, those additional terms also apply. If they conflict with these Terms, the app-specific terms control for that Service.
2. Service provider
The Services are provided by Lagodish Tech, located at Złota 75A, 00-819 Warszawa (Wola), Poland. References to “Lagodish Tech,” “we,” “us,” or “our” mean this provider.
3. Eligibility
You must be legally able to enter into these Terms. If you are under the age of majority where you live, a parent or legal guardian must approve your use. An individual Service may set a higher minimum age.
4. Licence to use the Services
We grant you a limited, personal, revocable, non-exclusive, non-transferable licence to use the Services for their intended purpose, subject to these Terms and any applicable store rules. We and our licensors reserve all rights not expressly granted.
For iOS apps, your licence is limited to use on Apple-branded products you own or control, as permitted by the Apple Media Services Usage Rules, including eligible Family Sharing or volume-purchase access. Unless a custom agreement is shown for an app, Apple’s Standard EULA applies to the licence for that app, and these Terms supplement it.
5. Acceptable use
You must not:
- Use a Service unlawfully or violate third-party rights.
- Copy, modify, reverse engineer, decompile, or derive source code, except where applicable law expressly permits it.
- Bypass security or access controls, interfere with operation, or introduce malicious code.
- Resell, sublicense, rent, or commercially exploit a Service except where its documented functionality permits commercial outputs.
- Use a Service to infringe privacy, intellectual-property, publicity, or other rights, or to create or distribute unlawful content.
- Use automated means in a way that imposes an unreasonable load or disrupts other users.
6. Your content
You retain ownership of content you create, import, scan, record, or export using a Service. You are responsible for that content and for having the rights and permissions needed to process it.
If you deliberately submit content to an online feature, you grant us a limited licence to host, process, transmit, and reproduce it only as needed to provide, secure, and support that feature. This licence ends when the content is deleted, subject to reasonable backup and legal retention periods described in our Privacy Policy.
7. Privacy and device permissions
Our Privacy Policy explains how we handle personal data. A Service may request device permissions such as camera, photos, microphone, Bluetooth, motion, or location only when needed for a feature. You control these permissions through iOS Settings, although disabling one may prevent the related feature from working.
8. Purchases and subscriptions
Purchases made in an iOS app are processed by Apple and are subject to the App Store terms shown at purchase. Prices, currencies, taxes, free trials, renewal periods, and available plans may vary by storefront.
Auto-renewable subscriptions continue until cancelled through your Apple account settings. Deleting an app does not cancel a subscription. Apple handles billing and refund requests under its policies and applicable law. We may change future pricing or features, but changes to an active subscription take effect only as allowed by Apple and applicable consumer law.
9. Updates and availability
We may add, change, suspend, or discontinue features, and compatibility may vary by device, operating-system version, country, and plan. We may provide updates needed for security, reliability, or compatibility. We do not promise that every feature will always be available.
10. Third-party services
A Service may link to or interoperate with Apple or other third-party services. Their terms and privacy policies govern your use of them. You must comply with applicable third-party agreements, including your mobile carrier and App Store terms.
11. Intellectual property
The Services, including their software, design, text, graphics, trademarks, and branding, are owned by Lagodish Tech or its licensors and protected by applicable law. These Terms do not grant permission to use our names, logos, or trademarks outside normal use of the Services.
12. Warranties and disclaimers
To the maximum extent permitted by law, the Services are provided “as is” and “as available.” We do not guarantee uninterrupted operation, complete accuracy, or suitability for a particular professional, safety-critical, medical, financial, or legal purpose.
Nothing in these Terms excludes warranties or remedies that cannot be excluded under applicable consumer law. For an iOS app that fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price as provided by the Standard EULA. Apple has no other warranty obligation for the app to the extent permitted by law.
13. Limitation of liability
To the maximum extent permitted by law, Lagodish Tech is not liable for indirect, incidental, special, consequential, or punitive loss, or for loss of profits, revenue, business, goodwill, or data arising from use of a Service. Our aggregate liability relating to a Service will not exceed the greater of the amount you paid for that Service during the 12 months before the event giving rise to the claim or USD 100.
These limits do not apply where prohibited, including liability that cannot be limited for fraud, wilful misconduct, personal injury, or mandatory consumer rights.
14. Suspension and termination
You may stop using a Service at any time. We may suspend or terminate access if you materially breach these Terms, create security or legal risk, or if a Service is discontinued. Provisions that by their nature should survive termination—including ownership, disclaimers, liability, and dispute terms—will survive.
15. Additional Apple App Store terms
- These Terms are between you and Lagodish Tech, not Apple. Lagodish Tech, not Apple, is responsible for the app and its content.
- Apple has no obligation to provide maintenance or support for the app. Contact Lagodish Tech using the details below.
- Lagodish Tech is responsible for product claims and for addressing third-party intellectual-property claims concerning the app, subject to applicable law.
- You represent that you are not located in a country subject to a US government embargo or designated as supporting terrorism, and are not on a US government restricted-party list.
- Apple and its subsidiaries are third-party beneficiaries of these Terms for iOS apps and may enforce the applicable provisions against you after you accept them.
16. Governing law and disputes
These Terms are governed by Polish law, without regard to conflict-of-law rules. Courts in Warsaw, Poland have jurisdiction, except where mandatory consumer law allows you to bring a claim in the courts of your habitual residence or requires another law or forum. Nothing in these Terms limits mandatory rights available to consumers in the EEA, UK, Switzerland, or elsewhere.
17. Changes to these Terms
We may update these Terms to reflect changes to the Services or law. We will post the revised version and update the date above. If a change is material, we will provide additional notice when required. Continued use after the effective date means you accept the revised Terms, to the extent permitted by law.
